Monthly Wash Club Terms and Conditions

1. Membership

• Your credit card will automatically charge each month until the Membership is canceled or terminated.
• No prior notice will be provided for monthly charges unless the charge date or amount changes.
• The Membership cannot be combined with any other offers, discounts, prepaid washes, or gift cards.
• Members may upgrade to a different wash plan or pay the difference at the time of wash.
• Only the vehicle enrolled is eligible for the Monthly Wash Club and can wash the vehicle ONCE a day in the calendar month.
• Splash Auto Wash reserves the right to be closed due to inclement weather, holidays, equipment maintenance, and upgrades.

2. Vehicle Eligibility and Wash Frequency​

The Monthly Wash Club membership applies exclusively to the vehicle enrolled at the time of registration. Members are entitled to one wash per day for their registered vehicle throughout each calendar month. Please note that only the specific vehicle listed under the membership is eligible for this daily wash benefit; substitutions or use with other vehicles are not permitted under these terms.

• The Membership is per personal vehicle. Taxis, limos, app-based transportation services (including but not limited to Uber and Lyft), and other professional transportation vehicles are prohibited.
• Splash Auto Wash may terminate a Membership upon violation of these terms and conditions.

3. Transferability​

• Membership is transferable upon purchase/lease of a new vehicle and upon notice to Splash Auto Wash.
• Members must notify Splash Auto Wash of any change in vehicle ownership.

4. Termination​

• Splash Auto Wash participates in a Safe Business Practices Environment.
• Splash Auto Wash may terminate the Membership at any time due to violations including:
• Driver negligence
• Not obeying attendant’s loading instructions
• Verbal or personal assault of staff
• Requiring local authorities to resolve ongoing issues
• Misrepresentation of enrolled vehicle (e.g., license plate switching without prior approval)

5. Cancellations​

• To cancel your membership, you may contact us by calling 313-584-9274 or via email at contactus@splashautowashusa.com.
• Cancellations must be received at least seven (7) days prior to the next billing date; otherwise, you may be charged for that month and the cancellation will not be effective until the following billing date.
• No refunds or credit will be given for partial periods.

6. Modifications​

• Splash Auto Wash reserves the right to modify or cancel this program and the Membership at any time.
• No prior notification of such changes will be provided unless the date or amount changes, in which case Splash Auto Wash will provide at least 30 days’ notice prior to payment being collected.
• If Splash Auto Wash increases the monthly charge by 10% or less, you waive any written notice of such increase to the amount of the recurring monthly charge.

7. Dispute Resolution; Class Action Waiver​

• To the fullest extent permitted by law, you and Splash Auto Wash agree that any dispute, claim, or controversy arising out of or relating to your Membership or these Terms and Conditions will be resolved on an individual basis only.
• You expressly waive the right to participate in or bring any class action, collective action, private attorney general action, or other representative proceeding in court or arbitration.
• No arbitrator or court may consolidate claims or allow proceedings on a class-wide basis.

8. Opt-Out Option​

• You have the right to opt out of this Class Action Waiver and Arbitration Agreement.
• To exercise this right:
• You must send written notice of your decision to opt out to Splash Auto Wash, Attn: Legal Department, Splash Auto Wash 5330 Wyoming Street, Detroit, MI 48210, or via email at contactus@splashautowashusa.com.
• The notice must include your name, contact information, and a clear statement that you wish to opt out.
• This notice must be received within 30 days of your acceptance of these Terms and Conditions.
• If you opt out, you will retain the right to bring claims in court, but you will not be able to participate in class or representative actions.

9. Severability​

• If the Class Action Waiver is found unenforceable for any claim, then the arbitration agreement will not apply to that claim.
• However, the waiver and arbitration agreement will remain enforceable for all other claims.

10. Governing Law​

• This agreement will be governed by the laws of the State of Michigan.
• Member consents to the exclusive jurisdiction and venue of the state or federal courts located in Wayne County, Michigan.
• Purchasing a membership means you agree to these terms and conditions.

11. Text Messaging and Marketing Opt-Out​

• By providing your phone number, you consent to receive text messages and marketing communications from Splash Auto Wash.
• Message and data rates may apply.
• You may opt out of receiving marketing text messages at any time by replying STOP to any message or by contacting Splash Auto Wash at contactus@splashautowashusa.com.
• Opting out of marketing messages will not affect your membership or other communications related to your account.
